These Terms & Conditions ("Terms") govern your access to and use of the my-career.digital website, its associated applications, and any related services (collectively referred to as the "Platform"). By accessing or using the Platform, you agree to comply with these Terms. If you do not agree with these Terms, please do not use the Platform.

Acceptance of Terms

By accessing or using the Platform, you agree to be bound by these Terms, which constitute a legally binding agreement between you and my-career.digital. These Terms apply to all users of the Platform, including but not limited to those that apply and are successfully admitted as a certified my-career.digital coach (the "Coach").

Use of the Platform

By accessing or using our platform, training programs, and certification services, you (the "Coach") agree to be bound by the following Terms and Conditions.

The Service & Purpose

my-career.digital provides an all-in-one digital workspace designed to facilitate the practice of life coaching. This includes, but is not limited to, the "Command Center" (Dashboard), "Engine Room" (Session Management), "Digital Memory" (Client Profiles), and "Daily Compass" (Task Management). We also provide training and certification for aspiring coaches to professionalize their practice.

Relationship of Parties

The Coach is an independent contractor and business owner. Joining the platform does not create an employer-employee relationship, partnership, or joint venture between the Coach and my-career.digital. The Coach is solely responsible for their own business registration, taxes, and professional insurance.

Professional Standards & The "Core Workflow"

To maintain the integrity of the my-career.digital brand, Coaches are encouraged to adhere to the platform’s 10-Step Coaching Workflow.

• Human-First Ethos: Coaches agree to prioritize practical life problem solving and a non-directive, supportive approach.
• Competency: Coaches must not misrepresent their level of experience or certification.
• Conduct: Coaches shall not engage in any behavior that is illegal, unethical, or brings the platform into disrepute.

Platform Usage & AI Integration

• Native AI: The platform utilizes natively embedded A.I. to assist with administrative "heavy lifting." While the AI provides summaries and task tracking, the Coach remains solely responsible for the accuracy and ethical application of any AI-generated content.
• Security: Coaches are responsible for maintaining the confidentiality of their login credentials. Any activity under the Coach’s account is the Coach's responsibility.

Client Data & Privacy

• Confidentiality: Coaches must maintain strict confidentiality regarding all "Client Profiles" and "Confidential Coach Notes."
• Data Ownership: Coaches do not own the data of their specific clients; however, the platform does and also processes this data to provide services. Both parties agree to comply with relevant data protection laws (e.g., GDPR, POPIA, or CCPA).
• Digital Memory: Coaches acknowledge that the "Digital Memory" feature is a tool for better service and agree to use it ethically.

Fees, Billing, and Refunds

• Subscription: Coaches agree to pay the monthly or annual fee associated with their chosen tier.
• Certification: Fees for training and certification programs are separate from platform subscription fees unless otherwise stated in a bundle.
• Refunds: Digital products and certification fees are non-refundable once the course material has been accessed.
• Tokens: Tokens represent the currency of the platform and each token translates into $45 (less all platform administrative fees and all payment processing fees) payable to the Coach at the end of every month, for every session where the Coach has claimed a respective token. Any token associated with any session that has a dispute or has a complaint raised for whatever reason is excluded from eligibility for payment. my-career.digital also reserves the right to withhold such payments if there is any indication of suspicious or unethical behavior by the coach for whatever reason. Any amounts payed to the Coach will be done so using the Payment Information provided on the Platform. It is is the responsibly of the Coach to ensure the accuracy of the Payment Information provided and my-career.digital is not responsible for any payments made to incorrect accounts. my-career.digital reserves the right to change the dollar ($) value of a token any any time.

Intellectual Property

• The Platform: All software, workflows, training materials, and the 10-step coaching workflow are the exclusive intellectual property of my-career.digital.
• The Coach’s Brand: The Coach retains all rights to their personal branding, original content, and marketing materials created through the platform or otherwise.

Limitation of Liability

my-career.digital provides the infrastructure for coaching but is not responsible for the results of the coaching sessions.

• The platform is provided "as is" without warranties of any kind.
• my-career.digital shall not be liable for any lost profits, loss of data, or incidental damages resulting from platform downtime or the Coach’s business decisions.

Termination

• By Coach: You may cancel your subscription at any time via the website.
• By Platform: We reserve the right to suspend or terminate access if a Coach violates these terms or the ethical standards of the coaching profession.

Community & Forums

Coaches joining our forums agree to maintain a professional, supportive, and empowering tone. Harassment or "spamming" of other coaches or clients will result in immediate removal from the community.

Governing Law

These terms shall be governed by and construed in accordance with the laws of South Africa.
